You can choose not to provide certain information, but then you may not be able to enjoy the features of the website or complete trip bookings. If you do provide certain information by which you can be identified when using this website, you can be assured that it will only be used under this privacy policy.

How We Use This Information
The Company is not in the business of selling personal information. The Company currently shares information only as described below. Understand that our policies are subject to change without notice and will be periodically reviewed.
The Company will share your personally identifiable information with other companies/individuals when:
We will provide your information to third-party vendors to perform functions on our behalf and to assist us in providing booking services to you. For example: sending an email, processing credit card payments, and providing customer service and services to you. The information shared is consistent and limited to that which is necessary to perform their services and not used for any other purposes.
We release account and personal information to comply with the law to provide your information, to enforce or apply our Website Terms & Conditions, or to protect the rights, property, and safety of the Company or others; We sometimes send offers and promotions to select users which may be of interest to you. You may unsubscribe from all the Company mailing lists at any time. We provide travel suppliers with your contact information once you book a trip. You may request to unsubscribe from travel supplier mailing lists at any time; or We will otherwise release information with your consent, by direct permission or after allowing you to opt-out or select to not share that such information.
Security: Protection of Information
We know that you deeply care about your privacy and data security. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place the appropriate physical, electronic,
and managerial procedures to safeguard and secure the information we collect online. The Company stores its contact information in our email marketing system, as well as a text messaging system when a user opts in for text messaging services. Credit/Debit card information (including card number, CVV/CVC, expiration, and name on card) is stored at a secured third-party credit card processing company and is not transmitted through our websites or servers. We restrict access to your personal information to those who need to know that information to process your booking request.

Links to Other Websites
Our website may contain links to other Internet websites. The Company, however, does not provide security or ensure your privacy while using other websites. By clicking their link and accessing their website, the information, and data that you provide them is not covered under this privacy policy. Please read the privacy policy of any third-party website before providing them with any personal information. If you do not want to provide them with any automatic information data, you should not access their site.
Limitation of liability
You hereby warrant to Xpressions Travel that it has the legal right and authority to acknowledge and accept the terms and conditions set out under this Policy. Subject to the above, Xpressions Travel, nor any of their respective employees, officers, agents, subsidiaries, or any other associated third parties accepts any responsibility or liability for or makes any representation or warranty, express or implied, that the Personal and Sensitive Data disclosed by you is accurate or complete.
Xpressions Travel reserves the right to modify these Terms and Conditions without prior notice. Your continued use of the site or booking forms indicates acceptance of the modified Terms and Conditions.

Terms and Conditions

Please read all these terms and conditions set out under this Agreement.  Xpressions Travel can accept your Booking and make a legally enforceable agreement without further reference to you. 

 Application  

By accessing the Xpressions Travel website or booking a trip you have agreed to the terms and conditions and you are giving consent for Xpressions Travel to act on your behalf for your travel needs. By booking a trip, you agree to be bound by this Agreement. The terms "we", "us" and "our" refer to Xpressions Travel, and the term “you" or 'I" refers to the individual who signs this agreement.

Our Agreement with You: 

Xpressions Travel offers retail travel services to customers, which are provided by separate and independent vendors of travel services. Xpressions Travel does not operate, control, or otherwise provide the services of independent travel vendors. I agree and understand that Xpressions Travel is not responsible for any operating failures, loss, damage, delay, or injury to me or members of my traveling party, nor for consequential damages, which may result from failure, delays, or injuries, which arise out of or during the scheduled travel. I agree and understand that Xpressions Travel is not responsible for any damages, direct or consequential, which may arise as a result of acts of God, social or labor unrest, war, political or national strike, terrorist activities, mechanical failures, climatic conditions, pandemics, or any other actions or omissions beyond the control of  Xpressions Travel.

 

Interpretation 

1. Customer means an individual acting for purposes that are wholly or mainly outside his or her trade, business, craft, or profession. 

2. Contract means the legally binding agreement between you and Xpressions Travel for the supply of the Services.

3. Booking means the Customer's payment for a Booking offered by Xpressions Travel, in Booking to receive Services from Xpressions Travel.  

4. Services mean the travel agency services that are provided by Xpressions Travel, by the description set out in the Booking.  

 

Basis of Sale

The description of the Services advertised does not constitute a contractual offer to sell the Services. When a Booking has been submitted on the Website, Xpressions Travel can reject it for any reason, although Xpressions Travel will try to tell you the reason without delay.

The Booking process is set out on the Website/email. Each step allows you to check and amend errors before submitting the Booking. 

A Contract will be formed for each Booking, only when you receive an email from Xpressions Travel confirming the Booking (Booking Confirmation). You must ensure that the Booking Confirmation is complete and accurate and inform Xpressions Travel immediately of errors. Xpressions Travel shall not be responsible for any inaccuracies in the Booking placed by you. By placing a Booking, you agree to Xpressions Travel giving you the confirmation of the Contract using an email with all information in it (i.e. the Booking Confirmation). 

Any quotation or estimate of Fees (as defined below) is valid for a maximum period of 3 days from its date unless Xpressions Travel expressly withdraws it at an earlier time.

No variation of the Contract, whether about the description of the Services, Fees, or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and Xpressions Travel in writing.

Xpressions Travel intends that this Agreement applies only to a Contract entered into by you as a Customer. If this is not the case, you must tell Xpressions Travel so that Xpressions Travel can provide you with a different contract with terms that are more appropriate for you and which might, in some respects, be better for you.

 

Packages and Suppliers

We sell and promote a range of travel-related products from different suppliers and service providers. Each Supplier has its own terms and conditions that apply to your particular needs and we endeavor to inform you of them.

All bookings including flights are subject to price changes until the required payments are made. Any increase in charges will be at a cost to you and not us. We do not accept cash, checks, or link payments.

 

Deposits and Payment

Any deposits from you to secure a booking, including the required custom Plan to Go fee, unless otherwise stated are deemed non-refundable.

Payment of a deposit enables the suppliers to hold a reservation for you but, does not guarantee the price. The price can only be guaranteed once we receive payment in full and confirmation of the booking, and it is secured and subject to any terms and conditions of the Supplier. You will be advised at the time of paying the deposit when full payment is required. Upon receiving this information, you are giving consent for us to debit your credit card with the relevant amount to the corresponding suppliers. We reserve the right to refuse personal checks as a method of payment.

We are not liable for any double charging of your credit/ debit card or refund that is not of our doing. We will endeavor to assist you if a problem arises. However, it is ultimately your responsibility. We generally send documents to our customers electronically whenever possible. Should a request be made for any documents to be sent as hard copies, an administration fee will apply.

 

Cancellations and Amendments

Once we have purchased your travel package, your contract is now between you and the suppliers, and they may amend or cancel your bookings. As your travel professionals, we will ensure that you are promptly notified through email in the first instance of any significant changes, once we become aware of such changes before your departure. However, we will not accept liability for any changes or costs incurred that may result in this action. You will then have the choice of accepting the change of arrangements accepting an offer of alternative travel arrangements if one is made available by the Supplier or canceling your booked arrangements and receiving any applicable refunds as determined by the Supplier’s terms and conditions. We do not guarantee that any refunds will apply.

 If we have booked you a flight and we are alerted to a significant schedule change by your airline before you leave your country of departure, we will contact you by email to advise you of this. Please ensure that you have given us an updated version of your contact email address and phone number, possibly your cell and that you regularly check for messages before you leave. We have no control over any airline schedule changes or delays and we will not accept liability for costs that may arise as a result of cancellations, delays, changes, or amendments.

 If you are booked to change airports or flights, it is your responsibility to check with the airline that any onward flights you have confirmed are operating as booked. Xpressions Travel strongly recommends that you contact your airline at least 72 hours before the scheduled departure of each flight, making sure you have a confirmation number. Please note that for some airlines you must confirm with them before you fly.

*Baggage fees: are a separate fee payable at the airline counter upon checking luggage in. This is not included in your airfare unless otherwise noted.

*VAT TAX is a tax that some resorts/hotels apply upon check-in or check out, this is NOT included on your booking unless otherwise noted.

 

Changes to Your Booking

 If a change is requested by you to your travel arrangements and is permitted and possible by the suppliers, our standard service fee of $50 will apply in addition to any additional Supplier’s charges. Please contact us to inquire about changes and if it is possible to request any changes. Please note that all reservation changes are subject to additional charges, availability, and the terms and conditions of the suppliers and the package purchased.

Name changes are treated as cancellations by most airlines and Suppliers. We will endeavor to accommodate any changes if necessary, but please bear in mind that a charge by the airlines and Suppliers would apply under their terms and conditions. Flights must be taken in the order they appear on your ticket or e-ticket confirmation. If any reason you cannot take a flight as booked, please contact us in advance to discuss your options. You need to check in on time for a confirmed reservation, otherwise, the airline may register you as a ‘no-show’, which could result in extra charges and/or your entire flight itinerary being canceled and/or rendering your ticket void.

 

Cancellation of Your Booking

In the event you cancel your booking, you may be entitled to a partial refund by the Supplier(s) terms and conditions. In addition to the cancellation terms and conditions of your Supplier(s), a fee(s) will apply that will be outlined on your itinerary/booking confirmation. If you decide to cancel arrangements before the balance due date, the terms and conditions of the Supplier(s) will go into effect.

Refunds will only be paid to you once the Supplier(s) are informed and by their terms and conditions. Generally, flight tickets cannot be refunded if they are partially used or Basic economy unless otherwise noted. Xpressions Travel is not responsible for a Supplier’s failure to pay a refund. If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer. Please read and review each document, carefully. A $50 cancelation fee is in effect and will be paid before the cancellation of the trip.

 

Airline Reservations

It is your responsibility to ensure that all of the details on your ticket and other travel documents are correct and you must bring to our attention any errors or discrepancies immediately after receiving your completed itinerary. Your travel documents are valuable and should be kept safe and secure. It is advised that you print 2 copies of your travel documents. Leave one copy with a close relative or friend and take the other copy with you. It is not always possible to replace travel documents in the case of loss, theft, damage, etc www.state.gov

Before booking international travel, we recommend that you review the Government’s prohibitions, warnings, and advisories applicable to your destinations. By offering travel to a range of destinations, we will not state your choice of destination is safe or without risk. However, we will advise you of any alerts and information relevant to your destinations if known to us.

AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN
 Your airline ticket is a contract between you and the air carrier, even if you purchase through Xpressions Travel. Suppose you purchase air travel through Xpressions Travel. In that case, you acknowledge and agree that Xpressions Travel does not have the right to control the operations of independent airlines, and agree that Xpressions Travel is not liable for any personal injury, or property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations. 
You understand and agree that Xpressions Travel functions solely and exclusively as a booking agent for the air carrier, that we do not handle or hold client funds for airline tickets, and that we are not the Merchant of Record under the meaning of that term under the Department of Transportation's regulations. Because Xpressions Travel does not hold or handle client funds, you understand and agree that any refund for canceled or delayed flights, baggage fees, or seat assignments must come directly from the airline and not from Xpressions Travel.

 Xpressions Travel shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. Airline e-tickets expire a year from the issue date unless carrier fare rules in the passenger’s itinerary fare provide otherwise.

Due to enhanced security, it is strongly recommended that you check in at least 2 hours before scheduled departure for domestic flights and 3 hours before scheduled departure time for international flights. Reconfirm flight times at least 24 hours before scheduled departure time for domestic flights, and 72 hours prior for international flights. Frequent Flyer mileage accrual is at the discretion of the airline(s). Xpressions Travel has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status, or certificates. Seat assignments are not guaranteed even after they are assigned, and Xpressions Travel has no control over airline seat assignments. Most airlines charge a fee to pre-book a seat. 

 

Passport, Visa, and Immigration 

It is your responsibility to fulfill and adhere to the passport, visa, and other immigration requirements applicable to your destination in line with the laws of the designated country. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not adhering to any such requirements. We will advise you of what documents are required. However, you are responsible for ensuring that all your relevant documents are valid.

* You agree that your passport will be valid for at least 6 months after travel and that there is no damage including but not limited to tears, water damage, writing, folds, or any other damage. You are aware that you can be denied boarding if any damage exists to your passport.

 

Travel Insurance

Travel insurance is a vital part of your booking. We strongly advise that you take out adequate insurance for the duration of your journey including medical. Travel insurance is mandatory with some travel arrangements and destinations. We may be able to arrange travel insurance to be provided to you through our suppliers, but by law, we do not sell travel insurance or can Give you any Travel Insurance advice.

Limitation of Liability

IN NO EVENT WILL XPRESSIONS TRAVEL OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR BOOKING OF A TRIP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

 

Indemnification

You agree to defend, indemnify, and hold Xpressions Travel harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of (1) Booking of a trip;  (2) breach of these Terms and Conditions; (3) any breach of your representations and warranties outlined in these Terms and Conditions; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Site with whom you connected via the Site. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding that is subject to this indemnification upon becoming aware of it. 

 

Travel Advice and Vaccinations

It is your responsibility to find out what is needed and make the arrangements for the necessary vaccinations for your itinerary. Should you need assistance, we will guide you to the necessary website for the country that you intend to visit. By signing this form, you accept responsibility and absolve Xpressions Travel of any responsibility for Vaccinations.

WELLNESS: At times We may book wellness travel for clients, which may include yoga, meditation, medi-spa, and other activities, treatments, and services intended to maintain, manage, or improve travelers’ health and well-being (“Activity” or “Activities”) We have no specialized knowledge of the practices or techniques employed by our Suppliers, and make no representations of the qualifications of the professionals and practitioners who offer these Activities. We make no representations that by participating in these Activities there will be any demonstrable improvement in your physical, mental, emotional, or spiritual well-being. We are not responsible if your participation in these activities leads to a worsening of any condition you may have. We are not responsible for any injuries you may sustain, or illnesses you may contract, including injuries or illnesses that may result in loss of life. You acknowledge that you are voluntarily participating in the Activities on your itinerary and that you understand that there are risks associated with your participation in the Activities, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death or economic loss. These injuries or outcomes may arise from your own or other’s actions, inactions, or negligence, or the condition of the Activity location(s) or facility(ies). Nonetheless, you assume all risks of my participation in the Activity, whether known or unknown to you, including travel to and from the Activity (including air travel) or any events incidental to the Activity. 

 

Pregnancy and travel

Cruise lines will deny boarding with pregnancies over 24 weeks. Some suppliers/tour guides can deny your attendance on adventure tours. A refund is not guaranteed nor implied. Zika is rare but still prone in certain geographical areas of the world. It is your responsibility to obtain information on the geographical area you are traveling to. You agree to hold Xpressions Travel harmless of any indication of Zika or complications after Travel during pregnancy.

 

Your Acceptance of the Terms and Conditions

In booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, including any additional terms and conditions of any Supplier that are necessary to your booking, travel arrangements, tours, or any website content. You are agreeing on behalf of yourself and those you represent to comply with all the terms and conditions, including any payments of all amounts due to relevant suppliers. You agree that any violation of any such terms and conditions may result in

 - the cancellation of your reservation or purchase,

- the loss of any monies paid for your reservation flight, accommodation, or otherwise,

- you being denied access to the applicable travel-related product or service dealing with Xpressions Travel and any third parties that work with us, and

- our right to debit your account for any costs incurred as a result of such violation.

 We do not knowingly represent anyone under the age of 18 therefore, you have agreed that,

 - you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use,

- you are legally authorized to act on behalf of those you represent to conduct and make arrangements on their behalf and to accept these terms and conditions on their behalf,

- You will ensure that only one person is dealing with us to arrange the travel, eliminating any conflicting arrangements,

- the information supplied by you and other members that you are representing is true and correct,

- you are responsible for informing such persons involved in all terms and conditions applicable to their travel arrangements and

- you understand that you are financially responsible for any use of our services or website by you and any parties using your name and information.

Travel Disclosure

We do not need to know if you have a criminal history, however, you understand and accept any travel restrictions based on your criminal history. International travel, including cruises, will require an immigration check that may not allow you to travel if you were convicted of a felony, have back child support, a DUI, or other legal issues. If you are on parole, you must have permission from your parole officer to travel. If you have finished your sentence, even if it was many years ago, we urge you to visit Travel.State.Gov and check for any restrictions to your destination. Some destinations have more strict rules than others. By signing this form, you accept responsibility and absolve Xpressions Travel of any responsibility if you are denied travel due to criminal history OR lack of proper documentation.

 

Obligations

You understand that it is your responsibility to have proper travel documentation for the destinations you are traveling to. If you have questions about your travel documentation, you acknowledge that you will refer to www.travel.state.gov and will ask questions of your travel agent well in advance of travel. Xpressions Travel, the agent, nor the tour operator with which we book your trip are responsible for ensuring that you have proper travel documentation.

 

Review travel advisories:

 Be aware of your surroundings, and stay alert at all times. Examples of this include:

  • Not looking at your phone when walking from a parking lot to your hotel room.

  • Keep your doors and windows locked.

  • Securing your valuables in your hotel room safe or at the hotel’s front desk.

  • Not leaving your drink unattended so that it can be spiked with illegal substances.

  • Reviewing the latest travel advisories for all cities, states, and countries visited.
